A limited driving privilege is a judgment issued in the discretion of a court for good cause shown authorizing a person with a revoked or suspended driver's license to drive for essential purposes, such as employment or education. These privileges allow for necessary driving for certain purposes, at certain times, within certain geographic areas and sometimes with other certain limitations imposed. If you are caught driving outside the limitations, then you are driving while license revoked.
Under the North Carolina Law, license points are assessed upon conviction of every moving violation. The Department of Motor Vehicles (DMV) uses the points system to determine if a person's driving privilege merits revocation due to an excess of traffic violations.
Automatic revocations occur with an accumulation of eight points within a twelve-month period or twelve points within a three-year period.
Mandatory revocations also result from convictions of speeding 15 miles per hour over the limit at a speed in excess of 55 miles per hour, and for speeding in excess over 80 miles per hour.
There are numerous ways in which an uninformed motorist could find his or her driving privileges revoked. Therefore, it is wise to consult with an attorney before resolving any traffic violation.
